Trump Attack Ad or Fact?
While serving as California's Attorney General, Harris initially defended the state's Department of Corrections refusal in 2015 to provide gender reassignment surgery for a prison inmate charged with murder.
But later that year, Harris declined to appeal the landmark case which paved the way for California to become the first state to fund a complete sex-change operation for an inmate.
By 2019, during her presidential campaign, Harris had taken an even more radical stance on the issue.
She filled out an ACLU questionnaire indicating that, as president, she would use executive authority to provide gender-transition services for inmates at the federal level…
- “I support policies ensuring that federal prisoners and detainees can receive medically necessary treatment for gender transition, including surgery, while incarcerated or detained.”
Hold up. Detainees as well?
According to the Department of Justice: “Detention is the temporary holding of individuals accused of Federal crimes or those awaiting sentencing or deportation.”
By that definition, yes, as the Trump ad notes, noncitizens held in the federal system — even temporarily — would also be eligible for these taxpayer-funded, elective surgeries if Harris were president.
When pressed, Team Harris now says: “That questionnaire is not what she is proposing or running on.” But until Harris herself says what she is proposing, we can only draw conclusions from her past actions.
The ad, then, is less an attack. More a statement of absurd facts.
And there’s a direct throughline from inmate “rights” in Harris’ home state of California to the recent case of Jonathan C. Richardson, serving a 55-year prison sentence in Indiana.

Jonathan C. Richardson told police: “Well all I know is I killed the little f---ing bitch.”
Last year, the ACLU sued the Indiana State Department of Corrections to provide gender reassignment surgery for Richardson (see above), arguing that withholding such treatment equals “cruel and unusual punishment.”
In September, a federal judge agreed, ruling Indiana’s 2023 law banning gender-affirming surgery in prisons violates inmates’ constitutional rights.
But unlike Kamala Harris’ tenure as California Attorney General, Indiana’s AG announced on Wednesday that he will appeal the judge’s decision.
“Prisoners like the convicted baby murderer in this case don’t have a constitutional right to gender transition surgeries, much less to have taxpayers foot the bill,” says Indiana Attorney General Todd Rokita.

Indiana's AG is taking a stand for decency, for law-abiding citizens. When given the opportunity, Harris did not.
Harris' support for these taxpayer-funded surgeries for prisoners, even violent ones, shows how out of touch she is with average Americans — many who can't afford basic healthcare themselves.
Yet Harris wants to spend public money on elective procedures for criminals. Which seriously calls into question her ability to represent the interests of everyday citizens.
